Amid rampant Beltway speculation and growing calls for an unequivocal position on marriage from LGBT groups and the national media, President Obama said in a Wednesday interview with ABC News’ Robin Roberts, “It is important for me to go ahead and affirm that I think same-sex couples should be able to get married.”

The president’s decision, he explained, stemmed from his own experience with gay staff in committed relationships as well as the continued discrimination against gay service members, who can now serve openly in the military following repeal of “don’t ask, don’t tell” but are denied the same basic equal rights as their heterosexual counterparts.

I just wrote him and you can to
Sir

I just watched the video of you speaking about gay marriage. Sir how can you say that good law abiding citizens are not moral? How can you say that the morals of 23 other countries are lower because they have full gay marriage or full civil unions. That they believe in not jamming region down people’s throats? Are you saying that the morals of the people of Canada, Israel, Spain and Nepal is lower than in this country? It sure sounds that way. Have you forgotten about the separation of state and church?

I’m waiting for your answer and your answer will be posted on my web site US immigration woes dot com
Thank you

By Debbie Siegelbaum on the hill

House Democrats are questioning where nearly $750,000 in federal funds to outside counsel, hired to defend the Defense of Marriage Act, will come from.

On Tuesday, what began as a House Appropriations Legislative Branch subcommittee hearing on the fiscal 2013 budget request for several government agencies, including the Office of the Chief Administrative Officer, quickly devolved into a partisan fight over the allocation of resources to defend DOMA.

Subcommittee ranking member Mike Honda (D-Calif.) questioned CAO Daniel Strodel as to where he had gotten the funds that were later transferred to the House’s Office of General Counsel.

Strodel testified that the money had come from the House Salaries, Officers and Employees account. The Department of Justice had not contributed any funds to the House’s defense of the law.

Honda questioned why, in a time of increasing congressional fiscal austerity, the House could find funding for an “unconstitutional law that separates all of us.”

Honda’s Republican colleague on the subcommittee, Rep. Steven LaTourette (R-Ohio), immediately pounced on Honda’s qualification of DOMA as unconstitutional, instead placing blame for the spiraling costs of the House’s defense of DOMA on the Department of Justice.

“[We’re] paying the Justice Department to oppose a statute that is a valid statute signed into law by President Bill Clinton,” he said. “It’s the law of the land, and [remains so] until a court reaches the conclusion that it’s unconstitutional or unworkable.”

By NORMA LOVE the huffington post

CONCORD, N.H. — New Hampshire lawmakers on Wednesday rejected a bill that would have made their state legislature the first one to repeal a gay marriage law, handing gay-rights supporters a key victory in the Northeast, where same-sex marriage is prevalent.

The state House voted 211-116 to kill the measure, ending a push by its new Republican majority to rescind New Hampshire’s 2-year-old gay marriage law. Nevertheless, both sides are pledging to continue fighting into the fall elections.

Repeal opponents hoped to solidify what they argue is public support for gay marriage, while supporters hoped to reverse the law in a region of the country where gay-rights groups have strength.

“Today is a banner day for the freedom to marry,” said Craig Stowell, co-chairman of Standing up For New Hampshire Families. Stowell said the House, where Republicans hold a 189-seat advantage, was supposed to give conservatives their best shot at repeal. “They blew it. This was supposed to be the most favorable legislative climate for repeal and they couldn’t even get a majority.”

The Republican-backed bill called for repealing gay marriage in March 2013 and replacing it with a civil unions law that had been in place in 2008 and 2009. Gay marriages occurring before the repeal took effect would have remained valid, but future gay unions would have been civil unions. The bill also would have allowed voters to weigh in on the issue through a nonbinding November ballot question.

Tom Czapieo, 63, of Keene, watched the House debate from the gallery with his partner, Mike Bellrose, 61. Czapieo said he was surprised and thrilled by the vote, even though he and Bellerose have no immediate plans to marry.

“I was born this way. I should have the right to marry who I want,” he said.

Bellrose noted that the House session began with the Pledge of allegiance, and quoted the ending passage: “with liberty and justice for all.”

“This certainly is a big step toward that,” Bellerose said.

Two men were removed from an Illinois rally for Rick Santorum after they shouted over the presidential candidate and kissed in front of a crowd of 2,100 people.

The event was held at the Christian Liberty Academy in Arlington Heights. Fifteen minutes into Santorum’s speech at the academy, Timothy Tross and Ben Clifford shouted loud enough to get the attention of the crowd and then kissed in front of everyone. Guards booted them from the rally, while the crowd strangely chanted, “U.S.A.”

“I don’t think the message should be about what my sexuality is,” Tross told the Palantine Patch. “It’s the message that he’s saying about sexuality that matters.”

Outside of the academy, protesters showed solidarity against Santorum’s antigay stances. Some protesters were alumni from nearby Christian schools (Santorum spent his senior year at nearby Carmel Catholic High School).

“There was something that bothered us about having someone so offensive in our hallowed halls,” Sue Delabruere, a former student of the school that later became the Christian Liberty Academy, told the Patch.

BY Trudy Ring posted on the Advocate

A gay Costa Rican immigrant in Texas has won a reprieve from deportation because of his marriage to an American man, in what is reportedly the first such ruling in that state.

A Houston immigration judge Thursday ended the deportation proceedings against David Gonzalez, who married U.S. citizen Mario Ramirez in California in 2008, during the brief period legal same-sex marriages were available there, the Houston Chronicle reports. They later moved to Texas.

The case is “the first in Texas to end in a reprieve based in large part on a same-sex marriage to a U.S. citizen,” the Chronicle reports. There have been similar actions involving married gay binational couples in California, New Jersey, and other states.

“It’s great news,” Immigration Equality spokesman Steve Ralls told the paper. “It’s consistent with similar actions we are seeing in other cases with lesbian and gay couples.”

President Obama’s administration has made some changes in enforcement of immigration laws, such as allowing an immigrant’s relationships to be considered in deportation decisions, that have benefited gay couples. However, immigrants who are in same-sex marriages continue to have difficulty obtaining work permits. Gonzalez has no legal right to work in the U.S., indicating the need for further reform, Ralls told the Chronicle.

“It is definitely good news that the administration is beginning to drop deportation proceedings, but now the individuals who are spared from deportation need to be able to receive that legal recognition that is so important as they continue to build a life here with their U.S. citizen partners,” Ralls said.

In a Friday Vatican address to visiting American bishops, Pope Benedict XVI condemned the growing push for marriage equality in the United States, AFP reports.

“Sexual differences cannot be dismissed as irrelevant to the definition of marriage,” said Pope Benedict, who warned of “the powerful political and cultural currents seeking to alter the legal definition of marriage.”

The pope’s comments come one week after Maryland became the eighth state to approve marriage rights for same-sex couples, though the bill signed by Gov. Martin O’Malley does not go into effect until January and likely faces a voter referendum this fall.

In meeting with the group of bishops from three Midwestern states, the pope echoed American election-year rhetoric against the Obama administration, decrying “threats to freedom of conscience, religion, and worship which need to be addressed urgently so that all men and women of faith, and the institutions they inspire, can act in accordance with their deepest moral convictions.”

The Advocate has identified five more co-chairs of President Obama’s reelection campaign who not only back marriage equality, but also want it in the party platform.

WASHINGTON — Three congressional Democrats and California’s attorney general have joined a growing group of President Obama’s campaign national cochairs who support a pro–marriage equality plank in the 2012 Democratic platform.

In responses to The Advocate, U.S. senator Michael Bennet of Colorado joined California attorney general Kamala Harris and U.S. representatives Jan Schakowsky of Illinois and Charles Gonzalez of Texas in favoring Democratic platform language that affirms marriage rights for same-sex couples.

Organized labor’s representation on the committee — the AFL-CIO’s Maria Elena Durazo of the Los Angeles County Federation of Labor — has also indicated her support for adding to the platform. All five are among the 35 national cochairs tasked with on-the-ground outreach and advising the campaign on key issues. “They each share the president’s vision for a future where every American can have a fair shot at success, where hard work pays off and responsibility is rewarded,” Obama for America campaign manager Jim Messina said in a statement last week.

That the cochairs’ vision for marriage rights in America doesn’t quite jibe with the president’s current “evolving” position has not kept them from going public on the issue. They join three fellow cochairs who have staked out the same position: Human Rights Campaign president Joe Solmonese, New Hampshire senator Jeanne Shaheen and former Wisconsin senator Russ Feingold.

Bob Egelko SF Gate

There are 18,000 married gay and lesbian couples in California and at least 131,000 nationwide according to the 2010 census, conducted before New York state legalized same-sex marriage in July. Rick Santorum says he’ll try to unmarry all of them if he’s elected president. Once the U.S. Constitution is amended to prohibit same-gender marriages, “their marriage would be invalid,” the former Pennsylvania senator said Dec. 30 in an NBC News interview. “We can’t have 50 different marriage laws in this country,” he said. “You have to have one marriage law.” The comments didn’t attract nearly as much attention as Santorum’s recent invocation of his Catholic faith to denounce government support for birth control, prenatal testing and resource conservation – which, in the last case, he attributed to President Obama’s “phony theology.”But his declared intention to nullify past as well as future same-sex marriages has reinforced his position to the right of the other Republican contenders, even though each of them has also voiced fervent support for traditional unions. Mitt Romney, who was governor of Massachusetts when the state’s high court became the first in the nation to declare a right to same-sex marriage in 2003, backs a constitutional amendment to outlaw such marriages in the future, but says he’d leave currently wedded couples alone. Newt Gingrich also wants an amendment but hasn’t said whether it would be retroactive. Ron Paul opposes same-sex marriage but wants the federal government to stay out of it – no federal benefits for gay and lesbian couples, no federal court authority to overturn state laws like California’s Proposition 8 and no constitutional amendments overriding a state’s prerogative to decide which of its residents can marry.

The Advocate has learned of a high-level meeting with LGBT groups where the administration rejected a hold on deciding gay couples’ green card petitions.

WASHINGTON, D.C. — The Obama administration is standing firm against calls by LGBT rights groups and lawmakers to put a blanket hold on deciding green card petitions from married, binational gay couples. Instead, those petitions in all likelihood will continue to be rejected, denying much-needed stability for gay families stuck in the nation’s immigration system. While the administration has taken affirmative steps in recent months to ensure that foreign nationals married to American spouses of the same sex are spared from actual deportation, officials told LGBT rights groups in a recent, high-level meeting that they will not hold such marriage-based green card petitions in abeyance. The decision is being criticized by some advocates as a campaign-year calculation based on politics, not on sound legal analysis. A year ago today, Atty. Gen. Eric Holder announced that the Obama administration would not defend a section of the Defense of Marriage Act that bars gay married couples from full federal rights and responsibilities of civil marriage. Those rights include the ability to sponsor a foreign spouse for permanent residency in the United States.
The administration has since pledged to continue enforcing the law, though it has declined to defend DOMA in multiple lawsuits and has worked around some of the 1996 law’s more severe consequences. President Obama issued a 2010 memo mandating hospital visitation rights for LGBT partners and spouses, for example, while the Justice Department dropped its opposition last year against joint bankruptcy filings by gay couples. But providing broad immigration relief to gay binational couples as DOMA’s constitutionality is decided appears to be a bridge too far at this point. The meeting between LGBT advocates and government officials occurred January 30 at the Department of Justice in Washington, D.C. and was attended by representatives of Lambda Legal, the National Center for Lesbian Rights, the Human Rights Campaign, Immigration Equality, and Gay & Lesbian Advocates & Defenders, The Advocate has learned. The administration in turn sent a contingent of senior officials from the White House, DOJ, and the Department of Homeland Security. According to multiple sources, those in attendance included White House LGBT liaison Gautam Raghavan, White House associate counsel to the president Kathleen Hartnett, Tony West, the assistant attorney general for the Justice Department’s civil division; and DHS executive secretary Philip McNamara, who last fall was appointed as an LGBT liaison to a Homeland Security working group reviewing the nation’s approximately 300,000 pending deportation cases.

this is what i wrote
I’d like to know why your group and the right wing always use morals, and in your case always use kids that need loving homes pawns in your fight against gay marriage or full civil unions. I’m not sure if you know that there are 23 countries right now that offer full gay marriage, or full civil unions, or common law? Countries like Canada, Spain, Israel, a tiny country like Nepal. Are you telling me that the morals in those countries are less then here, or the kids don’t get loving homes from gay couples that want to adopt?
I’d love to get an answer

By Melanie Asmar Denver west word blogs

Gay advocacy group One Colorado has started an online petition to fight against what it calls “scare tactics” by Catholic Charities, whose reps testified at the Capitol last week that if lawmakers legalize civil unions, it may stop providing adoption and foster care services. Why? Because civil unions could lead to same-sex marriage, which Catholics oppose.
That was the word from Colleen Haggerty, who spoke on behalf of Catholic Charities and the Archdiocese of Denver. “We hold the institution of marriage and the family a sacred pillar of our faith,” she said, noting that Senate Bill 2, which would authorize any two unmarried adults — regardless of gender — to enter into a civil union, “undermines the privileged place of marriage.”
The bill, she said, “may unnecessarily jeopardize services to the children in the most need of our help” — kids requiring foster care and those up for adoption. “These are the very people who would be hurt,” she added.
Bill sponsor Senator Pat Steadman, a Denver Democrat, challenged Haggerty. “I don’t understand how this bill would impact you and in fact, I’m wondering if you’ve read the bill,” he said. “Because on page eighteen, it clearly states that, ‘This bill is not to be interpreted to require child placement agencies to place a child for adoption with a couple that has entered into a civil union.’ So I’m not understanding your objections.”
“I have read the bill, and I have it right here,” Haggerty said. “I believe I said that in other states that have this — this is setting a precedent…where civil unions lead to the recognition of same-sex marriage. Innate in our faith and the cornerstone of what the Catholic church believes is the institution of marriage is one man and one woman, so to recognize this in any other way would go against what we believe.”
“And for that you’d stop serving the vulnerable in our state?” Steadman asked.
“That’s not what I said,” Haggerty said.
Later, in response to a question, Steadman said, “The abandonment of a charitable mission because we have to be charitable to all is a rather disappointing position.”
One Colorado agrees. In an e-mail to supporters titled “Shocking,” director Brad Clark wrote, “You know what scares me the most? Catholic Charities is putting vulnerable children in the middle of this debate, and I don’t want thousands of kids to become collateral damage in the crossfire. That’s just not right.
“I hope you’ll help us send a message to Catholic Charities. A message of appreciation for the important work they do — and a request for that work to continue, even after all families are granted equal protection under the law.”

LGBT advocates fight Catholic Charities’ threat to stop adoptions if civil unions are legalized

Just bigots using kids to try and get there way, it’s our way or now way, what pigs!

By Diane Anderson-Minshall advocate

Federal judge Jeffrey White, who was appointed during George W. Bush’s presidency, has ruled the Defense of Marriage Act unconstitutional. According to Think Progress, White, a judge in the U.S. District Court for Northern California, ruled in favor of Karen Golinski, an attorney and employee of the U.S. Court of Appeals for the Ninth Circuit, saying that her rights had been violated under the equal protection clause of the U.S. Constitution when she was denied spousal benefits that heterosexual employees receive.

In 2009, Chief Judge Alex Kozinski had ruled in Golinski’s favor, saying that not providing those benefits violated the Ninth Circuit’s employment policies prohibiting discrimination based on sexual orientation, according to our earlier reports, but the U.S. Office of Personnel Management immediately announced that it would not comply with Kozinski’s ruling, arguing that DOMA excluded same-sex couples and it lacked the legal authority to extend those spousal benefits to Golinski, even though she and her wife were legally wed.

Today’s ruling is a victory for Lambda Legal, which represented Golinski, and other opponents of DOMA. According to Ginny LaRoe of The Recorder, who live-tweeted the trial today, White, yet another GOP appointee to vote in favor of gay rights — Judge Vaughn Walker, of Proposition 8 fame, was as well — said that DOMA should now be “subjected to heightened scrutiny. But it also fails even rational basis review.” It is also, as Think Progress notes, “a serious setback” for Republican leaders in Congress, who have taken over the defense of DOMA in lawsuits after Obama administration officials announced they would no longer make a case for it.

Paul Babeu’s Mexican Ex-Lover Says Sheriff’s Attorney Threatened Him With Deportation

Phoenix new times
Monica Alonzo

Pinal County Sheriff Paul Babeu — who became the face of Arizona border security nationally after he started stridently opposing illegal immigration — threatened his Mexican ex-lover with deportation when the man refused to promise never to disclose their years-long relationship, the former boyfriend and his lawyer tell New Times. The latest of the alleged threats were made through Babeu’s personal attorney, who’s also running the sheriff’s campaign for Congress in District 4, the ex-lover says.He says lawyer Chris DeRose demanded he sign an agreement that he would never breathe a word about the affair. But Jose (New Times is withholding his last name because Babeu and his attorney have challenged his legal status) refused. The 34-year-old from central Mexico charges that the sheriff’s lawyer warned against mentioning the affair with Babeu. DeRose said gossip about Babeu would focus attention on Jose, attention that could result in his deportation, Jose says.
Melissa Weiss-Riner, Jose’s attorney, confirms her client’s account.
She says she spoke directly to the sheriff’s lawyer, DeRose, about the Babeu camp’s threats that Jose could be deported if he “revealed the relationship.” She says DeRose falsely claimed that Jose’s visa had expired.”Jose came to our firm because he felt he was being intimidated, and he was in fear for his life,” Weiss-Riner says. “He wanted his legal rights protected.”Babeu didn’t respond to requests for comment by publication time for this article, but his attorney, DeRose, says the dispute between Jose and the sheriff concerned Jose’s work on Babeu’s websites. He says Jose was a former volunteer who hacked into a campaign website.DeRose didn’t immediately address the other claims against him and the sheriff, except to say, “I never threatened to deport anybody” and that “[Babeu's] not threatening anybody.”Informed of the situation, Nancy-Jo Merritt, a longtime Phoenix immigration attorney, says such a threat would be indicative of an “atmosphere that’s been created politically in this state, so that if you get angry at someone who is Hispanic, you immediately jump down to the level of threatening to deport him.”If what [Babeu's attorney] says is correct [about Jose's being illegal], either the sheriff had a long relationship with someone he knew was undocumented, while all the time being Mr. Bluster about the border and using it for political gain,” or he threatened to deport someone he just broke up with, Merritt says.
“That’s just the worst kind of hypocrisy.”
She adds that federal immigration-enforcement agents have better things to do than “take care of Babeu’s boyfriends.”
Antonio Bustamante, a criminal defense attorney and immigration activist, tells New Times that if the allegations against Babeu are true, “To use a position of authority . . . and make legal threats opens a Pandora’s box of ethics issues for any law enforcement person or any elected person. In this case, he’s both.”
Jose says he met Babeu in October 2006 on gay.com, a dating website. What started with an online invitation from Babeu for the two to get together, he says, turned into not only a personal relationship but a professional one.
Jose says he created and maintained Babeu’s campaign websites, his Facebook page, and his Twitter account. Babeu didn’t pay him for his online services, he claims.
Jose says Babeu told him that he loved him and was with him exclusively. But Jose suspected Babeu was lying. The relationship soured, and Jose believes that Babeu sent DeRose after him. He says DeRose demanded the passwords to Babeu’s websites and social-media accounts. Jose says he complied but that Babeu and his attorney also wanted Jose to sign a document that would bind him legally to keep silent about the relationship.
Jose admits that he lashed out on news websites featuring stories about Babeu. He says he commented anonymously that the sheriff was not who people thought he was. He says he once wrote a comment on Chino Valley eNews that Babeu had an account on adam4adam.com, where gay men arrange sexual liaisons.
Jose shared text messages between him and Babeu with New Times. A September 4, 2011, text from the sheriff reads: “You can never have business after this and you will harm me and many others in the process . . . including yourself & your family.”
A couple of minutes later, Babeu followed with: “And you say you have loved me? Papi . . . this is no good.”
Jose responded: “Good threats. Wont work. Im already hurt me . . . and you didn’t care.”
They exchanged more texts on September 6.
Jose: “Dont threat me. Thats illegal. Im just speaking . . . true.”
Babeu: “You have crossed the line. Better get an attorney. You brother will also be contacted.”
The following day, on September 7, DeRose sent an e-mail directly to Jose ordering him to “cease and desist.”
DeRose wrote: “If you are serious about an amicable resolution to this, it is critical that no further offensive actions against my client be taken in the meantime. This should go without saying.”
Jose says that’s when he hired Weiss-Riner.

If you haven’t checked out Out4Immigration’s new project on tumblr, unitedbylovedividedbylaw.tumblr.com, please do–and then add on to it yourself! For those of us who have been in this struggle for a long time, change is coming and we can feel it. For those who are newer to the realities of what it means to be in a same-sex binational relationship, the need for change is no less urgent. This is a chance to “stand up and be counted”, and put a face to an issue that so many people still don’t understand exists!

We’re working out the kinks with the Tumblr site and welcome feedback if you have problems understanding how to make a submission. The main things we ask are that you download this sign template:

http://tinyurl.com/7fq7vpd

Then, take a picture or make a video, using the blank space on the sign to say something about your circumstance or story on it, so that any image will refer back to this site. You can look at some of the ways this has been addressed by folks who have already submitted, even without using the sign. The key thing for us is that we hope to have O4I’s logo and the URL of the Tumblr site represented in each photo or video submission.

In time we hope not only affected individuals and couples, but also friends, family, and community members will represent the many sides of this issue on this site. We have been a faceless segment of the community for far too many years, so please, make a sign, take a picture, get creative, post a video, and add your voice to the demand for change!

And again if you find the process unclear, or have other questions, please don’t hesitate to contact either myself, or Gina (gina@out4immigration.org). And please share and promote the site however you can.

Best–
Chris

ANNAPOLIS, Md. — The effort to legalize gay marriage has passed a long-standing hurdle in the Maryland House of Delegates.

The House voted 71-67 Friday to give gay couples the right to marry.

After a week of speculation on whether proponents would gather the votes needed, lawmakers debated it Thursday evening.

Several amendments to the bill were rejected. They included creating civil unions and allowing parents to opt out of education programs that address same-sex relationships.

The measure now heads to the state Senate where last year it easily cleared the 47-member body. The governor has said he would sign it.
