3/17/2010

I’ve been fighting to get the Uniting American families act passed for over 6 years now, the bill is as close as it has ever been to being passed and we cannot let up the pressure on getting this bill passed. If the new immigration reform bill does now have UAFA added onto it, then I’m going to do everything I can do to stop the bill in its tracks. Also why does it matter what the Catholic bishops have to say they don’t pay taxes the way I do.
Come on Peter King get with the program and sign on as a co-sponsor! Do something right.

President to meet with key senators on immigration

By SUZANNE GAMBOA, Associated Press Writer

WASHINGTON – President Barack Obama plans to focus attention on immigration next week by meeting at the White House with two senators crafting a bill on the issue.

White House spokesman Nicholas Shapiro said Obama will meet with Democratic Sen. Chuck Schumer of New York and Republican Sen. Lindsey Graham of South Carolina on Monday.

The president is “looking forward to hearing more about their efforts toward producing a bipartisan bill,” Shapiro said Friday.

The meeting will be the first Obama has had with Schumer and Graham on the proposal they are developing since they began focusing on it last year.

Immigration has taken a back seat to the economy and health care on Obama’s agenda since he took office just over a year ago. Immigrants and their advocates — promised by then-candidate Obama that he would tackle the issue in his first year as president — have been growing frustrated by the inaction.

Several community groups planned to vent some of that frustration in a news conference Monday in Washington. The groups also are trying to organize tens of thousands of people from around the country for a March 21 demonstration in Washington.

“The president’s commitment to fixing our broken immigration system remains unwavering,” Shapiro said

March with Immigration Equality: March 21st in Washington, D.C.

Thursday, March 4th, 2010

March with Immigration Equality: March 21st in Washington, D.C.

On Sunday, March 21st, Immigration Equality supporters from across the country will gather in the nation’s capital to take part in the 2010 March for America, a massive mobilization to call on Congress to pass comprehensive immigration reform this year.

Please make plans to join us in D.C. and send a visible, and vocal message that comprehensive reform must include LGBT families, too!

First, sign up on our website. We will stay in touch with information on logistics for the day of the March . . . put an Immigration Equality shirt in the mail for you to wear to the event . . . and send you details on our Immigration Equality reception, on the evening of March 20th, where you can meet other supporters from around the world.

Then, start making plans! We will be gathering at the World War II memorial at 11:30am on March 21st. Our staffers will be on hand to distribute signage (and feel free to bring your own!), and answer any questions you might have about the day’s activities. Then, we’ll walk together to the Lincoln Memorial, where tens of thousands of other immigration advocates will kick-off the March at 1pm.

Together, we can send a strong, unmistakable message that no reform is truly “comprehensive” unless it includes our families, too.
Sign up today, and join us in Washington as we bring our message, and our stories, to Congress and the world.

Don’t Get Mad, Get Even!

Defeat Hiram Monserrate

Hiram Monserrate is one of the 38 State Senators who voted no on the marriage equality bill on December 2, 2009. No only did he vote no, but he broke his previous commitment to support marriage equality when it came to the Senate floor for a vote.

Monserrate was convicted last year of assaulting his girlfriend, which led to his recent expulsion from the State Senate. But now he’s running to try to get back into the Senate. Our candidate in the March 16 Special Election is popular Assemblymember Jose Peralta, who has consistently voted in favor of marriage equality, transgender civil rights and other important LGBT issues.

Donate now to our campaign to get rid of Hiram Monserrate: “Don’t Get Mad, Get Even.” This is our first chance to replace an anti-LGBT Senator with a strong, pro-LGBT Senator. Every dollar that you contribute will go to making sure this shameful legislator does not return to the State Senate.

If you’re mad about the December 2 marriage vote, now is the time to get even. Join us in taking out Hiram Monserrate and electing Jose Peralta.

Replace Monserrate with Jose Peralta! Volunteer NOW!
Don’t get mad about Hiram Monserrate breaking his promise to vote for the marriage equality bill in the State Senate. Get even—NOW!

There are a number of important activities coming up this weekend and leading up to the March 16 Special Election where volunteers are critical to electing pro-LGBT Assemblymember Jose Peralta to the State Senate in Queens.

The Peralta campaign needs volunteers at their campaign office in Jackson Heights, Queens to phone bank and canvass on Saturday, March 6 and Saturday, March 13 starting at 10 AM; they also need help in Get Out the Vote efforts on Election Day—Tuesday, March 16. In addition, we will be doing our own phone banking for Peralta in the days leading up to the election.

Please contact Erin Drinkwater at edrinkwater@prideagenda.org or 212-627-0305 ext. 114 for details on any of these activities. Let her know if you are interested in phone banking and canvassing in Queens, phone banking at the Pride Agenda office, or both!

“Civil rights for all of my constituents and for all New Yorkers has always been a priority for me,” said Assemblyman José Peralta. “I have worked towards full equality for LGBT New Yorkers in my seven years as an Assemblymember, and I will be proud to continue this work as a member of the State Senate. I think my record in the Assembly demonstrates that when I take a principled stand on an important human rights issue like marriage equality, I don’t suddenly change my mind when the bill comes up for a vote.”

It’s time to get to work to elect Jose Peralta to the State Senate on March 16.

Immigration Equality – Uniting American Families Act – Binational Gay Couples
PLEASE GO AND VOTE

Binational couples are couples in which the partners come from different countries. Nineteen nations allow their citizens to sponsor their same-sex partners for immigration benefits. Unfortunately, the United States does not. Because of the Defense of Marriage Act, which defines marriage as between a man and a woman, even same-sex couples who have been legally married in U.S. states or foreign countries are not able to immigrate based on their marriage. Every day we hear from desperate couples, forced to choose between the partner they love and the country they love, which is why we are fighting to change the immigration law and end this discrimination

VIGIL AT THE MONUMENT:

VIGIL AT THE MONUMENT:
Americans From Across the Nation Gather To Raise Awareness of Our Plight: Unequal Treatment, Economic Hardship & Forced Exile

On Sunday, March 21, 2010, Americans in same-sex binatinal partnerships will gather at the Washington Monument in the nation’s capital to protest a situation that few Americans are even aware exists. We are Americans who suffer human rights violations due to unequal treatment in American law and policy that does not permit us to sponsor our foreign same-sex permanent partners to live with us in the States. Tens of thousands of Americans are in our heart-breaking predicament: we must choose between continuing our lives in the States or leaving American to live in exile simply to preserve and protect our primary family relationships.

Those of us participating in the Vigil will carry pictures of ourselves with our partners and represent binational families everywhere who are either separated, living in fear of deportation, or exiled in other countries where they are legally recognized as family units.

Twenty-one countries around the world permit their citizens to sponsor same sex partners: Australia, Austria, Belgium, Brazil, Canada, Denmark, Finland, France, Ireland, Germany, Iceland, Israel, the Netherlands, New Zealand, Norway, Portugal, South Africa, Spain, Sweden, Switzerland, and the United Kingdom. This list demonstrates how behind the times America is when it comes to extending human rights and equal treatment under the law to all our citizens.
It is time to take [the] constraint off the committed same-sex partners of American citizens.
Sen. Patrick Leahy, UAFA Judiciary Hearing, June 2009

Currently there’s a bill in Congress to correct this problem. It’s the Uniting American Families Act (UAFA) (HR 1024/S 424) introduced February 12, 2009 by Rep. Jerry Nadler (NY) and Sen. Patrick Leahy (VT). The UAFA has 120 co-sponsors in the House and 23 co-sponsors in the Senate. But it is not moving fast enough for binational families who suffer daily. As human rights activists we are not satisfied with the way the bill is stalled in committee. Apparently it will be used as a political football with some legislators hoping to include the UAFA in comprehensive immigration reform but others hoping it will go away. Vigil Participants don’t trust that the contentious context of immigration reform will be the vehicle to bring them relief. We want to see UAFA pass as a free-standing bill or signed into law by executive order as quickly as possible. Alternatively, if UAFA is to be included in other legislation we believe it would be a better fit to attach it as a jobs retention/jobs creation measure in, for example, a jobs bill.

The plight of binationals, as Sen. Leahy stated in the June 3, 2009 Judiciary Hearing on the UAFA is “unjust, cruel, and unnecessary,” Many of our lives are filled with havoc and uncertainty, loneliness and fear, economic sacrifice and for some instability and financial ruin. We are literally forced to exile ourselves from our lives and homes in America, just to keep our families together.

This [discrimination against same-sex partners sponsoring rights] makes no sense as economic policy in a competitive global marketplace.
Sen. Russ Feingold, UAFA Judiciary Hearing, June 2009

It is not in the economic interest of this country to force exile Americans. America benefits when it retains its citizens rather than loses them to other countries, which is what happens when Americans with foreign same sex partners leave and take U.S. dollars, opportunity, and talent with them, sapping the vitality of the communities we enrich here at home when we leave to be with our partners in countries that welcome us as family units. American homes are sold and that money is put into real property in foreign lands. Businesses are closed and employees laid off. For those of us that cannot manage the challenging option of rebuilding life in a foreign country, relationships are destroyed. A policy should not remain in place that causes wreck and ruin in the lives of Americans who cannot afford the extraordinary option of rebuilding life in a foreign country.

Family unity is economically sound policy for the U.S. because it keeps American dollars in the country. … The definition of ‘family’ is not restrictive and can and should also include non-traditional family units. … The definition of ‘family’ should not be interpreted so stringently as to omit people who are in a loving, committed relationship but happen to be of the same gender.

Julian Bond, Chairman, NAACP, UAFA Judiciary Hearing, June 2009

This policy damages not only those families, but U.S. society generally. …Many of these binational couples are forced to leave this country, depriving our nation of the economic, cultural, social and other contributions these individuals could make here.
Christopher Nugent, ABA, UAFA Judiciary Hearing, June 2009

Zoë Oka is the founder of the Committee to Advance Equality: “We deserve our rights exclusive of immigration reform and our rights should come before that fight begins. The challenge to adjust as many as twenty million illegal immigrants and set them on the path to citizenship is a separate struggle and it’s sure to be a three-ring circus, at least as contentious and unpredictable as the debate over health care. Why should the rights of Americans in committed, enduring relationships be subject to the volatility of that process without certainty that they will be protected? The UAFA is a simple solution. It needs to become the law now. With the current state of the law our lives are on hold indefinitely. Passage of the UAFA will put an end to our daily suffering and allow some of us to come out of the shadows, others to come home with our partners or at least have the right to visit the States. For people like myself, it would avoid having to up-root our lives to go live in exile in a foreign country, the reason being that we’re not treated equally here at home.”

“Until it happens to you, you don’t even realize it’s a problem — that people are suffering this sort of human rights denia and legal inequality. For all of the progress we’ve made, gays and lesbians are still often treated as undeserving second class citizens. Being in a binational relationship confers third class status on us and results in pariah status for our foreign partners who aren’t even permitted to enter the States as visitors once it is suspected that they have American partners. All you have to do is fall in love across the border and just watch your rights disappear” states Ms. Oka. “It’s important to understand this problem for what it really is: a human rights violation and unequal treatment under the law. Uncle Sam is constructively booting us out of the country because our partners are not Americans. The need for love and the right to form family relationships are our natural human rights. This problem is not negotiable. Human rights and equality are not popularity contests. We need relief now. America mus stop forcing Americans into exile in foreign lands.”

The Vigil at the Monument will occur simultaneously with a larger event, an immigration reform rally, also scheduled to be held in Washington DC on March 21.

American citizens in binational relationships are encouraged to come out of the shadows and join the Vigil. For additional information contact zoeoka@yahoo.com, founder of the ad hoc group Committee To Advance Equality For Binational Same Sex Couples. http://ctae.open-board.com

On Dec 16th, 2009, Rep Gutierrez jump started the Comprehensive Immigration Reform debate by introducing a CIR bill called “Comprehensive Immigration Reform for America’s Security and Prosperity Act” (CIR ASAP). We are disappointed that however he left out LGBT Families or the language of Uniting American Families Act in his CIR bill.

On February 9th, 60 members of congress from the the Congressional LGBT Equality Caucus, Congressional Hispanic Caucus, Congressional Black Caucus and Congressional Asian Pacific American Caucus sent a letter to President Obama, Senate Majority Leader Harry Reid, House Speaker Nancy Pelosi, Sen Schumer, Rep Lofgren expressing their strong support for a comprehensive immigration reform bill that would end discrimination against LGBT binational families.

Therefore, we should keep the pressure up and make sure that congress understand the issue and includes our families in any Comprehensive Immigration Reform

I just got off the phone with them and they do support the uniting American families act.
From there site
Whereas, we support legal immigration reforms that are fair and humane
We further advocate for allowing legal immigration of gay and lesbian partners/spouses from other countries to the same extent that it is legal for heterosexual spouses to gain citizenship. Discrimination by the federal government in this area is often overlooked. But to the many Americans who are trying to live with their foreign partner/spouse of the same sex this inequity is intolerable.
We also believe that discriminating against those infected with HIV/AIDS from traveling to this country is wrong and an outdated policy that hinders our country from advancing research and education on HIV/AIDS; and
Whereas, we support marriage equality for all Americans.
As a conservative organization, we recognize the value traditional marriage has served in our history. We believe that allowing same-sex individuals to marry with government recognition and responsibilities will add value and strength to the long-standing institution of marriage.
In recognizing there are bans on same-sex marriage in much of the country, we strongly advocate civil unions as an interim measure, provided it offers identical protections and benefits of heterosexual marriage laws.

Sir;
President Obama my congressman and senators, Valentine’s Day is coming up and just want you think if you couldn’t be with your loved ones. I’ve been in a relationship now over 8 years and can’t be with my loved one. That’s what’s happening with me all because of my government’s inaction to help me get my husband back into this country. I don’t know how many times I have to write and fax my government for help and not even getting a form letter from anyone over my problem. Please think if your loved ones where half way around the world and no hope of ever being with them in your home country. But then you being the president or my congressman and senators wouldn’t have that problem they would just do a special bill and they would be here. Mr president all you would have to do is make a phone call and tell my senators and congressman maybe even the American embassy in Malaysia to get off their butts and do something and my problem would just go away and I could be with the person I married and had to marry him in Canada all because Canada is not a bigoted country like this one.
Mister Obama how much longer do I have to wait and be alone, am I really going to have to leave the country I love to be with the person that I love to? Why is my country so backward when it comes to gay immigrations? Why Mr. President can’t I get any help with my problem? My lawyers tell me all my congressman and senators have to do is a special bill and he would be here but my congressman and senators who have all the paper work just don’t want to do anything to help. They could put pressure on the embassy in Malaysia for a new student visa but they will not do it. My government has totally let me down and it looks like the white house is all talk to and no action. My husband is a good law-abiding citizen and could bring a lot to this country if he could get back in.
So tell me mister president my senators and my congress men how much longer am I going to be kept apart from the person I love, how much longer is it going to be that we have to do Skype every night, how much longer is the only contact going to be throw text messages, how much longer is he not going to be able to drive his car or play with his dog. Tell me how much longer, anyone that could answer that question? Am I going to have to leave this country and live in Asia or Canada? What is wrong with my country? Why does my country hate me so much?
Thank you
Roy

Dramatic Show of Support for UAFA and Inclusive CIR in Congress

From Immigration Equality

In a dramatic show of support show of support for the Uniting American Families Act (UAFA) and LGBT-Inclusive comprehensive immigration reform (CIR), members of the LGBT Equality Caucus – a caucus of U.S. Representatives – sent a letter to President Obama and Senate and House leadership.
A huge majority of the caucus– sixty of its eighty-two members – signed on to the letter.
The letter urgently calls for comprehensive immigration reform and demands inclusion of LGBT families who have historically been locked out of our immigration system.
The letter adds a critical new constituency in Congress pressing for comprehensive immigration reform, adding to voices of four other influential caucuses: the Congressional Hispanic Caucus (CHC), the Congressional Asian Pacific American Caucus (CAPAC), the Congressional Black Caucus (CBC), and the Congressional Progressive Caucus (CPC).
And in an impressive show of solidarity, the leaders of those four caucuses – Nydia Velazquez (D-NY-12), Mike Honda (D-CA-15), Barbara Lee, and Raul Grijalva (D-AZ-7) and Lynn Woolsey (D-CA-6), respectively – all signed the letter. Rep. Luis Gutierrez, head of CHC’s immigration task force, also signed on.

Everyone still needs to keep on writing everyone yuo can think of keep it up my brothers and sister!

Senator John McCain
To Chuck Schumer
Sir:
I never thought that I would be calling you a liar and a cheat but I was wrong. When I watched you at the UAFA Senate hearing I was so happy that you where a senator from Long Island standing up to the right wing nuts, the church and all the bigots in this country. But after reading a story on Lezgetreal.com (http://lezgetreal.com/?p=25829) I was so wrong about you! I guess you are like all the rest that say something and turn around and do something else.
After I talked to L. Fresco in your office I thought I could just sit back and just wait till you came out with the bill on Immigration reform but once again my government let me down. He had told me that you where not going to include the UAFA into your bill till the Latino senators and congressman was made happy and they got their way. Because I was told they would block the bill and not support it. It looks like you couldn’t get there support so you turned your back on us.
Because of you and senator Gillibrand and Congressman Peter King I now have to make plans on leaving my country for good to be with my husband, yes we are legally married in Canada and 20 other countries. I’ve sent your office my marriage Lic, faxed it to your DC office, and hand delivered it to your long island office. Not only that I had sent the forms from the US state department to sponsor my husband but didn’t get an answer from you, Gillibrand, Peter King and the white house. This was to proof that I am legally married to a non American and asking for help to sponsor him into this once great country. But since this is a gay issue and an immigrations issue no one will help.
Just to let you know I am now going to contact ever single congressman, senator and newspaper in this country to let them know that you lied in a the senate hearing (6/2/2009) and because of your actions not including the uniting American families act into your immigration reform bill anther taxpaying US citizen has to leave his home land for good.
I’m really mad and upset that I’m sitting here and my husband is half way around the world all because of the Republican Party and the church that has it in for gay rights and civil rights. I’m really mad and upset that the Democratic Party for not having a back bone and standing up to the right wing. I’m also mad and upset that I can be legally married in 20 countries and the country that claims civil rights has very little to gay people. I’m also mad and upset at Chuck Schumer for talking the talk but can’t walk the walk! I’m, also upset that the US state department is handing out visas like water to the people of Haiti and I can’t get one for my husband who has legal rights to one being married to an American. What a wonderful country this is, ya right!
Thank you for your none help!

While we wait for immigration equality under the US Immigration and Naturalization Act -to sponsor our foreign-born partners, we endure unconscionable and inhumane situations on a day to day, hour by hour basis. Our partners are persecuted at our airports by the profiling of ICE officials and arbitrarily turned away, despite having visas; our relationships are denied through our inability to live together in the US, or we live in fear, hiding or exile

By Melanie Nathan, San Francisco, February 3, 2010 : Binationals and activists have been waiting patiently for Senator Chuck Schumer to introduce the enigmatic Immigration reform bill, and the LGBT binational community, whether in exile, living apart or hiding in fear, has been desperate for the answer. Urge White House to take a stand for Equal Immigration Rights for LGBT Couples!

A quote from White House spokesman Shin Inouye from March 2009.

Asked about Obama’s stance on UAFA [the Uniting American Families Act] and the likelihood of its inclusion in comprehensive immigration legislation, White House spokesman Shin Inouye said in a statement that: “The president thinks Americans with partners from other countries should not be faced with a painful choice between staying with their partner or staying in their country. We will work closely with Congress to craft comprehensive immigration reform legislation.” Source: Bay Windows

The White House’s “Civil Rights” web page, which says “He [Obama] supports full civil unions and federal rights for LGBT couples and opposes a constitutional ban on same-sex marriage.” Source: The White House website.

President Obama and his administration has made several comments over the past year to the media and on its own website supporting an INCLUSIVE Comprehensive Immigration Reform – with language that includes LGBT Families.

Please help us remind President Obama as well as his administration of his promise to our community and make sure that he keeps to his promise – that LGBT Families be included in Comprehensive Immigration Reform and that he will support FULL federal rights for all LGBT Couples, which includes the ability to sponsor their same sex partner for a green card.

Please go and vote, its up to us
